California Would Disbar Ted Cruz And 18 Attorneys General If It Could

Sen. Ted Cruz, Texas Attorney General Ken Paxton, and the attorneys general from 17 additional states should all be disbarred, according to the reasoning of the disciplinary complaint the State Bar of California filed Thursday against former Trump campaign attorney John Eastman. That detail is one of many buried in the 35-page, 11-count disciplinary complaint made public yesterday in the latest lawfare attack on attorneys who deigned to represent Donald Trump. 

State Bar of California’s Chief Trial Counsel George Cardona announced on Thursday the filing of disciplinary charges against Eastman, allegedly arising from Eastman’s engagement “in a course of conduct to plan, promote, and assist then-President Trump in executing a strategy, unsupported by facts or law, to overturn the legitimate results of the 2020 presidential election by obstructing the count of electoral votes of certain states.” The press release announcing the disciplinary charges further claimed that Eastman “made false and misleading statements regarding purported election fraud,” that provoked a crowd into assaulting and breaching the Capitol on Jan. 6, 2021.

The 11 charges against Eastman prove troubling throughout, with the State Bar of California proposing to discipline Eastman for presenting legal analyses to his client, Trump, and for speaking publicly on his views about the election, with the bar even attempting to hold Eastman responsible any violence that occurred on Jan. 6. The disciplinary complaint also misrepresents numerous arguments Eastman and others made concerning the 2020 election, falsely equating claims of violations of election law with fraud.

But it is count two of the disciplinary complaint, charging Eastman with “seeking to mislead a court,” that exposes the California State Bar as a kangaroo court.

“On or about December 7, 2020, the State of Texas filed a Motion for Leave to File Bill of Complaint in the United States Supreme Court, initiating the lawsuit Texas v. Pennsylvania,” begins count two of the complaint against Eastman. The complaint then explains that in that lawsuit, Texas argued the defendant states of Pennsylvania, Georgia, Michigan, and Wisconsin “usurp[ed] their legislatures’ authority and unconstitutionally revised their States’ election statutes.” As a remedy, Texas sought an order from the Supreme Court to “enjoin the use of unlawful election results without review and ratification by the Defendant States’ legislatures and remand to the Defendant States’ respective legislatures to appoint Presidential Electors in a manner consistent with the Electors Clause.”

Eastman, on behalf of then-President Trump, sought to intervene in the Texas v. Pennsylvania case, and in that motion, Eastman “expressly adopted the allegations contained in the Motion for Leave to File Bill of Complaint filed by Texas.” In adopting the allegations Texas made, Eastman, according to the California State Bar, “misl[ed] the Supreme Court by an artifice or false statement of fact or law,” in violation of California’s “Business and Professions Code” that governs attorneys’ conduct in the Golden State.

Under the California State Bar’s reasoning, then, Texas’ attorney general who filed the motion likewise “misled” the U.S. Supreme Court, as did the attorneys general of the 17 other states that supported Texas’ motion for leave to file a bill of complaint. So too would have Sen. Ted Cruz, had the Supreme Court agreed to hear the motion, as he had agreed to argue the case on Trump’s behalf in that circumstance. 

While count two represents but one of the 11 distinct charges levied against Eastman, it most clearly exposes the logical conclusion reached when state bars use disciplinary proceedings to conduct lawfare against political opponents. 

To date, the bars have limited themselves to targeting just a few attorneys working for Trump, with the D.C. Bar pursuing Rudy Giuliani and Jeff Clark, in addition to the California State Bar’s attack on Eastman. But there is no limiting principle to prevent the bars in other states from pursuing any politician with a law license who happens to represent the wrong person. 

That is an extremely dangerous precedent, which is why tomorrow at a press conference called by Eastman’s legal team, some big legal names will condemn the move. The hastily called conference is expected to bring together former U.S. Attorney General Edwin Meese III and John Yoo, a current professor of law at the University of California-Berkley, former general counsel to the U.S. Senate Judiciary Committee, and former deputy assistant attorney general. Former Wisconsin Supreme Court Justice Michael Gableman and former California Supreme Court Justice Janice Rogers Brown, among others, are also expected at the conference.

Whether the legacy media will cover Eastman’s detailed response to the State Bar of California’s disciplinary complaint or bother to report on his press conference remains to be seen. But if Cruz and the attorneys general impugned by the California State Bar speak out, the corrupt press may not have any choice but to report on the ridiculous theories underlying the disciplinary attacks on Eastman.

Republicans to Investigate Classified Documents Found at Penn Biden Center

Republicans in Congress say they will investigate the matter of classified documents found at the University of Pennsylvania’s Biden Center for Diplomacy from President Joe Biden’s time as vice president.

House Oversight Committee Chairman James Comer (R-KY) said Monday evening that his committee will send a letter to the National Archives and Records Administration demanding answers and is open to hearings depending on where the investigation leads.

“President Biden has stated that taking classified documents from the White House is ‘irresponsible,’” Comer said in a statement, according to Fox News. “Under the Biden Administration, the Department of Justice and National Archives have made compliance with the Presidential Records Act a top priority.

“We expect the same treatment for President Biden, who has apparently inappropriately maintained classified documents in an insecure setting for several years,” he added.

Rep. Mary Miller (R-IL) tweeted: “Joe Biden took classified documents to his private office and LIED about it to 60 minutes. Why isn’t the FBI raiding Biden’s Delaware homes right now? House GOP will investigate!”

CBS News first reported Monday that President Joe Biden’s lawyers discovered back on November 2, 2022 — right before the midterms — a batch of documents with classified markings from the time when Biden was vice president when clearing the center in Washington, D.C.

Biden used the center from mid-2017 until he began his 2020 presidential campaign, according to Biden’s lawyer Richard Sauber. Sauber said the documents were  locked in a closet in one of Biden’s private offices.

A reporter attempted to ask Biden about the documents before he was to begin a meeting with the Mexican president, but was rushed out of the room along with all press:

House Republicans decried the hypocrisy between the National Archives’ treatment of the documents found at the Penn Biden Center with classified markings found last year at former President Donald Trump’s Mar-a-Lago home in Florida.

House Freedom Caucus Chairman Andy Biggs (R-AZ) tweeted that as vice president, Biden did not have the authority to declassify classified documents.

“Biden stole classified documents and stored them at his think tank while he was VP,” he tweeted, before questioning the center’s status as a “think tank” and adding that it received $54 million in funding from the Chinese Communist Party (CCP).

Rep. Marjorie Taylor Greene (R-GA) also noted Biden did not have the power to declassify as presidents do.

“Joe Biden stole classified documents. This is a very serious crime. DOJ & NARA can’t sweep this under the rug AND persecute Trump,” she tweeted.

Numerous Republicans accused the Justice Department of having different standards of justice for Trump and Biden. The DOJ had convened a grand jury to look into Trump retaining any classified documents, and the FBI raided Mar-a-Lago to look for them.

Dan Bishop (R-NC) tweeted, “Two tiers of Justice cannot stand.”

Rep. Jamie Raskin (D-MD) defended Biden.

At least two House Democrats expressed concern, albeit somewhat muted.

Rep. Adam Schiff (D-CA) told CNN: “Obviously if there are classified documents anywhere they shouldn’t be that’s a problem and a deep concern.” However, he equivocated on whether there should be an investigation. “I probably don’t want to say more [until] I have a chance to read the article.”

Rep. Jim Himes (D-CT) told CNN: “Classified information needs to stay in secure spaces.”

Several Republicans senators also weighed in on the matter, although since they do not control the Senate, they cannot initiate investigations or hearings.

Sen. Ted Cruz (R-TX), however, did call for the convening of a grand jury.

Republican Senator Ted Cruz has weighed in on the revelations in Elon Musk’s ‘Twitter Files’ publication, urging that it is “evidence of corruption that goes to the highest level of government.”

Appearing on Fox News, Cruz asserted that the effort to crush the Hunter Biden laptop story went “to the highest level of the FBI. And it goes to the highest level of Big Tech.”

“We’ve known for a long time that big tech is censoring conservatives,” Cruz said, adding that “what Elon did here is he just laid naked all of the lies that the corporate media has told.”

“It’s clear during the 2020 election, over and over and over again, the Biden campaign and the DNC would reach out to their buddies at Twitter and say, hey we don’t like this, and their response is ‘handled,’ and they’d take it down, over and over and over again,” Cruz stated.

He continued, “And in particular, all of the exchange back and forth when the Hunter Biden laptop story broke, it was evidence that the leadership at Twitter knew within hours that their ridiculous, fake excuse that it was hacked was a ridiculous fake excuse.”

“Even James Baker, who…had been the FBI’s general counsel and then was at Twitter — even he acknowledged well, gosh, we don’t have the evidence on this, but it doesn’t matter, Let’s block it anyway,” Cruz noted, referring to the now fired Twitter Fed, who continued to try to censor Musk’s data dump.

Cruz further highlighted that in “one of the exchanges back and forth they reveal the reason, which is they say we want to avoid — we want to avoid what happened in 2016, Donald Trump winning.”

“This was all about weaponizing big tech. It is absolutely corrupt. And what is amazing is the Democrats were fully in on it,” Cruz charged, adding “The corporate media was fully in on it, and Elon’s released the receipts, which shows all of them are willing to abuse power to stay in power.”

Exclusive — Mitch McConnell Blocked from Moving Media Cartel Bill JCPA via Hotline

Senate GOP leader Mitch McConnell tried to move through the U.S. Senate a highly controversial plan called the Journalism Competition and Preservation Act (JCPA) using a procedure called a “hotline,” Breitbart News has learned.

Before the close of business on Thursday, at least two GOP senators–including Sen. Tom Cotton (R-AR)–objected to the effort and put a hold on the push. To stop a bill from being passed unanimously through the Senate via the “hotline” track, only one senator needs to object. Sources told Breitbart News that more Republican senators are racing to express opposition to the proposal, and they expect more holds to be placed in the coming hours and days ahead.

Jamming through such a controversial piece of legislation with this procedure in a lame duck session of Congress before the new Congress the American people elected in November’s midterm elections takes office on Jan. 3, 2023, would be a massive escalation in an already chaotic process for the JCPA the past two years.

The JCPA would carve out for establishment media outlets an antitrust exemption allowing them to form cartels to collectively bargain with Big Tech companies. Proponents of the plan argue it would even the scales and force the hand of Big Tech by making the tech giants pay media outlets for their content, but critics worry it could make many of the problems facing both industries much worse because of serious structural flaws in the bill.

Earlier this year, when the Senate Judiciary Committee moved to advance the bill, three different committee hearings were upended when an amendment offered by Sen. Ted Cruz (R-TX) undercut the coalition of GOP and Democrat senators who came together to draft the initial plan. However, Cruz eventually relented and betrayed conservatives by giving the proponents of the JCPA what they wanted and allowing the bill to advance.

The lead sponsors on the bill are Sen. Amy Klobuchar (D-MN) on the Democrat side and Sen. John Kennedy (R-LA) on the GOP side. Kennedy’s support for this, and for moving on it during a lame duck session, which makes it even more controversial, could seriously hurt any chances he has at the governor’s mansion in Louisiana in the 2023, as Louisiana Attorney General Jeff Landry has issued a clarion call to Americans to voice opposition to this legislation to their lawmakers. Landry is already running for governor and Kennedy may announce a campaign in the coming weeks or months ahead. If Kennedy runs, he would face Landry and whoever else runs in a jungle primary in November of next year.

Industry lobbyists pushing the JCPA ramped up their efforts last week and this week as this Congress enters its final month, and their hopes of getting this sweeping change to federal policy with regard to media and tech through Congress this year dwindle. The last ditch desperation push from industry insiders is putting heat on members of Congress, trying to get them to back the plan–or at least soften opposition–so they can get their handout through this year.

The pathways proponents might be able to get this structurally flawed legislation through Congress are limited in the final weeks before the new Congress takes over. They include trying to attach it to must-pass legislation like an omnibus spending bill or the National Defense Authorization Act (NDAA)–both of these paths seem less likely though still possible now that several GOP senators have formally expressed opposition to the plan during the hotline process–but also the senate could try to take up and pass the bill on its own as well.

Passing it via a standalone process would be complicated as well as a nasty and convoluted battle, and it would cost the Senate serious time in the final weeks of this year. The decision on whether to embark on such a monumental undertaking rests with Senate Majority Leader Chuck Schumer, who is balancing interests of several other Democrats in the remaining weeks that Democrats have a House majority.

House Democrats are expected to begin consideration of the proposal in the House Judiciary Committee next Wednesday, with outgoing chairman Rep. Jerry Nadler (D-NY) taking up the plan for a mark up in committee next week.

Corporate media mouthpieces like the women who co-host ABC’s “The View” are obsessed with using the dumb “election denier” moniker to smear Republicans. But their latest guest, Republican Sen. Ted Cruz of Texas, is setting the record straight on which party has a history of crying “illegitimate.”

During his guest appearance on “The View” Monday, Cruz pointed out that while his interviewers are busy demanding former President Donald Trump and other Republicans swear that the 2020 election was “legitimate,” they have repeatedly failed to hold any Democrats accountable for rejecting Republican victories.

“You don’t do it to Hillary Clinton, who stood up and said Trump stole the election. You don’t do it to Stacey Abrams who said that the election was stolen. They sat here and said it was illegitimate and you guys were fine with it,” Cruz said.

“And it was,” host Whoopi Goldberg yelled.

“So it’s illegitimate when Republicans win but not when Democrats win?” Cruz questioned.

It’s a fair thing to ask considering the fact that Democrats have objected to every GOP presidential victory this century. Instead of engaging the valid point that Cruz raised about leftists’ hypocrisy on elections, however, Goldberg changed the subject to the Jan. 6, 2021 Capitol riot.

“We may not like when Republicans win, but we don’t go and we don’t storm,” she said.

It was then that Cruz noted leftists do use violent actions such as rioting, looting, burning, vandalism, and even death threats to express their outrage when things don’t go their way.

“Did I miss an entire year of Antifa riots where cities across this country were burning and police cars were being firebombed?” Cruz asked. “Your position is the left doesn’t engage in violence, really?”

“I don’t know what an Antifa riot is,” Goldberg said.

Cruz did not back down from confronting the bickering hosts, even when protesters in the audience heckled both him and the other View hosts. Instead, he called out Goldberg and her girl gang for repeatedly denying that they have a double standard when it comes to elections.

When Ana Navarro cited a phone call from Hillary Clinton to Donald Trump in 2016 as proof that she “conceded the election,” Cruz pulled out papers from his jacket and began reading off a list of Democrats who refused to acknowledge that Republicans won fair and square.

“Hillary Clinton says Trump is an illegitimate president,” Cruz said, reading off of his paper. “Hillary Clinton says the election was stolen from [her]. Hillary Clinton in 2002: ‘George W. Bush was selected not elected.’ Joe Biden: ‘Al Gore was elected president.’”

In response, Navarro simply resorted to telling Cruz to “lower your voice because we are really close to you.”

Rep. Jim Jordan (R-OH), the ranking member of the House Judiciary Committee, appeared on SiriusXM’s Breitbart News Daily with Alex Marlow today, laying into the Journalism Competition and Preservation Act (JCPA) and questioning why Sen. Ted Cruz (R-TX) is attempting to rescue the derided media cartel bill.

“I’m not sure why the Senator did that, I do plan to talk to him,” Rep. Jordan, who has opposed the media cartel bill since its inception over a year ago, told Breitbart News Daily host Alex Marlow.

“We call it the media cartel bill,” said Marlow. “It’s giving an antitrust exemption to media so they can collectively bargain with tech giants, and this will supposedly get them paid for their content, I think it’s going to be a payola scheme where Big Tech will pay off whatever outlets they like the most.”

“You said it right, Big Media is going to team up with Big Tech, and they’re going to come after conservative outlets getting the truth out there like you guys. Remember, the cartels that form get to define and determine the terms on who gets in,” said Jordan.

“So, do you think the New York Times and Washington Post and Google are going to want Breitbart to be in? In fact, Lina Khan who’s over at the FTC and who is going to administer all this, she’s said of Breitbart, ‘they’re out there putting out disinformation.’”

“This is all in line with what we saw in the runup to the 2020 election, where it wasn’t the FTC, but it was the FBI going to Big Tech and teaming up… to limit information to the people. This whole alliance between Big Government, Big Tech, and Big Media to keep we the people from getting the facts and the truth is a problem, and I see this [the JCPA] in that same vein.”

Jordan explained how some Republicans were swayed by lobbying efforts, which misrepresented the bill as support for struggling local newspapers as opposed to the national conglomerates that largely own them.

“Some of them get in by ‘oh, we want to help your small town newspaper,’ you know, the days when the newspaper actually covered the news and wasn’t just propaganda… So I think there’s some nostalgic feeling for that.”

“We had this hearing a little over a year on, we brought in Clay Travis and Glenn Greenwald. It was funny, as the hearing went on, there were even some people who would co-sponsor the bill who, during this hearing, ‘You know, I’m having second thoughts.’ Because we started to spell it out.”

“They define who’s professional news — that’s one of the terms. The bias they have against folks like you guys who are putting out the truth, the facts. Remember, this is the same kind of mindset that gave us the whole ‘disinformation governance board.’ This is that concept, in my mind.”

“It is a way to structure government, and create these cartels, where they’re going to go after the little guys, they’re going to define it so you can’t even get in the cartels, and then they’re going to go after you and make life even more difficult for us in the conservative movement.”

“We see this time and time again, we saw it in the runup to the 2020 election, we see it when they tried this ‘governance board’ with Nina Janckowicz. I think it’s a dangerous road to go down, that’s why we’ve opposed it so far.”

Blackburn and Rubio Bust Myth: JCPA *Enables* Big Tech Collusion with Media

The Journalism Competition and Preservation Act (JCPA) was saved from legislative oblivion yesterday after Sen. Ted Cruz (R-TX) worked with the Democrats to rescue it, based on the false claim that the media and Big Tech are opposed to each other. But, as Sens. Marsha Blackburn (R-TN) and Marco Rubio (R-FL) have pointed out, nothing could be further from the truth.

The media cartel bill, said Blackburn in her earliest critiques of it, gives “even more power to the mainstream media and Silicon Valley.” More recently, she said the bill would allow “the liberal media and Silicon Valley to silence conservatives.”

Sen. Marco Rubio, similarly, has said the bill “Opens the door to greater collusion between big media and big tech.”

These critiques expose a fundamental weakness in a key argument made by the JCPA’s supporters, including Sen. Cruz. According to them, the media and Big Tech are opposed to each other.

In fact, the two entities have been working hand-in-glove for years to suppress independent media and control the flow of information on behalf of elites. The JCPA, which would allow the media to form a joint negotiating entity to collude with Silicon Valley, simply exacerbates that long-running trend.

There was a time, fast approaching the outer limits of generational memory, when the New York Times and CNN and other such media titans had to compete on an even playing field with independent creators.

If an independent creator got a million views overnight, that blogger would likely be on the front page of relevant Google searches and at the top of your Facebook feed.

Videos from independent creators recording from their parents’ spare rooms would routinely outrank CNN and NBC in YouTube search results.

Ordinary users could start Twitter hashtags and meaningfully elevate them, giving ordinary people unprecedented influence over the national conversation.

For a moment, it seemed like the slow, centralized, dinosaur brands of the legacy media were destined for the dustbin, outmatched and outcompeted by tens of thousands of independent voices.

That moment, which spanned the first half of the 2010s, now seems like a distant memory. Why? Because Big Tech colluded with Big Media to rig the playing field.

It doesn’t matter if content from CNN and the New York Times is less organically popular than content from independent creators. Google, Facebook, Twitter, and YouTube will force it onto your front page regardless of its organic momentum.

Google and Facebook do this via their prominently-displayed news tabs, where only handpicked sources are allowed to appear.

Twitter does it via the “what’s happening tab.” Formerly a list of trending hashtags driven purely by user activity, it now force-feeds you content from handpicked “authoritative” news sources, along with a few hashtags that aren’t deemed to be worthy of suppression.

And YouTube simply adjusts its search results whenever the legacy media complains.

On top of this, every major platform now employs armies of partisan “fact checkers”: a kind of digital stasi that hunts down alternative sources of news, identifying wronkthinkers so the platforms can then suppress them. The tech companies don’t even try to conceal that this ecosystem is a tool for the legacy media companies to suppress their competition: USA Today, for example, is a Facebook fact-checker.

It is against this backdrop – years of collusion between Big Tech and Big Media to suppress the latter’s competition – that Republicans like Ted Cruz have thrown their support behind the JCPA, which is a free pass for still further collusion. It is a supreme betrayal of voters who want the discredited legacy media replaced, not rescued.

Perhaps the Republican Senators who support this bill are hoping their voters are, by now, simply desensitized to betrayal. It would be a dangerous gamble to make, this close to the midterms.
