Pennsylvania Supreme Court Rejects Republican Challenge to Mail-in Votes

Bad news for President Trump and his supporters. The Pennsylvania Supreme Court unanimously rejected a Republican lawsuit suggesting all mail-ballots be disqualified. It looks like the state’s 20 electoral votes are Biden’s for good.

The Pennsylvania Supreme Court declared that House Rep. Mike Kelly and seven other Republicans waited too long to present their challenge to the court. Republicans were hoping to invalidate mail-in ballots and block the certification of the state’s voting results by challenging Pennsylvania’s Act 77. In 2019, the Pennsylvania state house passed Act 77, a bill which expanded the use of mail-in voting. The court was quick to point out that several elections have already taken place prior to this one and the state Republicans didn’t challenge Act 77 then.

The Supreme Court responded, “Having delayed this suit until two elections were conducted under Act 77’s new, no-excuse mail-in voting system, Petitioners— several of whom participated in primary elections under this system without complaint— play a dangerous game at the expense of every Pennsylvania voter. Petitioners waived their opportunity to challenge Act 77 before the election, choosing instead to lay by and gamble upon receiving a favorable decision of the electorate.”

On Friday, federal judges ruled against Trump’s legal team who were looking to block the vote certification in Pennsylvania. Their lawsuit claimed Republican poll watchers were not allowed to observe the ballot counting process and some voters were allowed to fix their defective ballots, often called ballot “curing.” In its rejection, the 3rd U.S. Circuit Court of Appeals asserts the Trump campaign cannot win the lawsuit in part because it “cites no federal authority regulating poll watchers.” The judges who wrote the rejection notice candidly state “these claims cannot succeed.”

Election fraud lawsuits

Rudy Giuliani joined Pennsylvania Republicans at a hearing where he blasted Pennsylvania’s handling of the race. “Your election – because of these two counties, and maybe one other – is a sham,” Giuliani said. He then claimed more than 600,000 mail in ballots were counted with no Republican supervision. “They could have been from the same person. There could have been multiples, there was no name on them.” Giuliani also said that 22,686 mail-in ballots were returned on the day they were mailed. 32,591 were returned the day after they were mailed, and 20,000 were returned before they were mailed. “And I think this is kind of a low count – I guess the crooks in Philadelphia are kind of disappointed about this – but there were 8,021 votes from dead people. Under the law of your state, those ballots are illegal.”

Pennsylvania Supreme Court Justice Wecht said, “It is not our role to lend legitimacy to such transparent and untimely efforts to subvert the will of Pennsylvania voters. Courts should not decide elections when the will of the voters is clear.” At this time polls show Joe Biden ahead of Trump by 81,000 votes. In 2016 Trump won the state, beating Hillary Clinton by 44,000 votes. Despite the court’s ruling, the Trump campaign has the opportunity to appeal to the Supreme Court, where President Trump has appointed three justices since he began his presidential term in 2017.
