Monkeypox: Should I Get Vaccinated?

I hope you are resuming normal life. But should you again hunker down because of yet another infectious disease threat?

The head of the World Health Organization (WHO), Dr. Tedros (not a medical doctor), has declared that monkeypox is a “Public Health Emergency of International Concern” (PHEIC), overriding the majority of his own expert committee of medical and scientific advisors.

It just so happens that there are two vaccines available. The government is paying to produce millions more doses. Should you grab one as quickly as possible?

One thing you should definitely do is abstain from sex with anyone except your faithful spouse. If everyone did that, the outbreak would fizzle out in two to three weeks. The vast majority of cases (98 percent) involve men who have sex with men. It is said that the vaccine might protect a person who receives it within four days after exposure, but there is no evidence to support this.

 Sexual contact is not necessary for transmission. A person could get infected through direct or indirect contact with the skin lesions, say by hugging or sharing towels.

Things to know about the vaccine:

  • Everyone who gets it is an experimental subject. The government thinks it should be effective against smallpox and is cousin monkeypox, but it is impossible to test for efficacy. There has been no smallpox for decades and very little monkeypox. People do make antibodies, but do they work?
  • According to the vaccine label, as many as 1 in 50 recipients had a “cardiac event of special interest,” and FDA documents showed that up to 18% (almost one in five) had an elevated troponin level, a blood test indicating possible heart damage.
  • The vaccine may be immunosuppressive. Around 7 percent of HIV-positive subjects had worsening of their HIV test results and may be more susceptible to other infections.

        The safe and effective way to avoid monkeypox is to avoid exposure and to practice excellent hygiene—not to rely on experimental vaccines and treatments.

The Association of American Physicians and Surgeons (AAPS) filed its amicus brief with the U.S. Court of Appeals for the 11th Circuit on Friday against the Biden Administration’s mask mandate on airplanes and other public transportation. The court is hearing Biden’s appeal from the April federal district court decision that invalidated his mask mandate.

“Mask mandates are tyrannical, and Congress never authorized the CDC to require travelers to wear masks,” stated Andrew Schlafly, General Counsel of AAPS. “Mask mandates infringe on two fundamental rights: freedom of speech and freedom of travel,” he argued in AAPS’s amicus brief.

The Biden Administration did not attempt to reinstate its mask mandate for travelers after it was blocked by a federal judge, amid widespread public opposition to the mandate. But Biden appealed to the 11th Circuit to seek authority to reinstate the mask mandate at any time, Mr. Schlafly explains.

Neither the government nor the parties filing briefs supporting it demonstrate effectiveness to Biden’s mask mandate, Mr. Schlafly argued in the brief. He cited multiple recent articles admitting to the ineffectiveness of mask mandates in different regions of our country.

“The ability to see another’s demeanor while he is speaking is often as important as the content of what he says,” the AAPS brief states. “Historically many American states and towns prohibited the wearing of masks, in order to avoid the harm they cause.” The brief cites how New York State banned mask-wearing for more than a century until the COVID-19 pandemic.

Mask mandates are more politics than science, and politics is to be sorted out in the halls of Congress rather than at a politically unaccountable administrative agency,” AAPS argues. “If Congress were to hold hearings on this issue, there would be a massive outpouring of public opposition to mask mandates,” Mr. Schlafly observes.

Despite how most schools imposed mask mandates last year, most do not now. “Fortunately, students will be able to speak and breathe without interferences by mandatory masks,” Mr. Schlafly added.

The Association of American Physicians and Surgeons (AAPS) decries the political prosecution and conviction of conservative Steve Bannon. After being denied his right to call House committee members at trial, a D.C. jury found Bannon guilty today under 2 U.S.C. § 192 of contempt of Congress.

“Political prosecutions are what dictatorships do, and should never happen in the United States,” declared Andrew Schlafly, General Counsel of AAPS. “Being a supporter and adviser to Donald Trump is not a real crime.”

Steve Bannon as a private citizen was targeted by the House Select Committee while spending millions of dollars for more than a year targeting Trump supporters about protests on January 6, 2021. The Department of Justice rejected a recommendation by this Democrat-controlled committee to prosecute former congressman Mark Meadows for the same charges that it prosecuted Bannon on.

“When the Republican House voted that Democrat-appointed Eric Holder was in contempt of Congress, DOJ immediately announced its refusal to prosecute him,” Mr. Schlafly said. “Yet DOJ went after Steve Bannon, and he was prevented at trial from calling any of the House Democrats who initiated this against him.”

“This prosecution and conviction of Steve Bannon are unprecedented,” observed Andrew Schlafly, General Counsel of AAPS. “This prosecution of Bannon merely advances the political goals of enemies of Donald Trump.”

During jury selection in Bannon’s case, many potential jurors expressed their political views against Steve Bannon. They were excused from the jury, but the prevalence of their views in D.C. indicated that the trial should not have proceeded there.

“D.C. is not a fair venue for a trial pitting Democrats in Congress against a critic of them,” continued Mr. Schlafly. “The incoming new Congress, predicted to be Republican, should change the law so that trials are held where defendant resides, not where federal government employs so many.”

“The incoming expectedly Republican House should enact a resolution to pardon Steve Bannon on its first day in session in January,” Jane Orient, M.D., the Executive Director of AAPS, stated.

One thing not in short supply is COVID boosters—and possibly mandates to get them.

The promise that the vaccines would end the pandemic has proved to be a false hope. The graph below shows that in Canada the most vaccinated people experience the most cases.

This shows the absolute number of cases, so the reason for fewer cases in the unvaccinated could be simply that there are not many unvaccinated people left. But clearly, the “one and done” concept didn’t work, and now we might only be considered “fully vaccinated” for a few months. Worse, as epidemiologist Dr. Harvey Risch of Yale points out, the benefit of the vaccine could turn negative after four to eight months. In other words, you become more likely to get infected.

If the spike protein in the prevailing strain changes, the vaccine-induced antibodies may interfere with your immunity instead of neutralizing the virus, Dr. Risch explained.

Twice-boosted President Biden tested positive and has mild symptoms, and everyone who has been in contact with him will be informed. (The vaccine does not prevent transmission.) Twice-boosted Dr. Anthony Fauci also got COVID, was treated with Paxlovid, and had a rebound with symptoms worse than with the initial illness after completing the five-day course.

Each and every dose carries a risk of adverse effects. A spike in cases of Sudden Adult Death Syndrome (SADS) has been called “baffling,” and its occurrence post vaccination is considered to be a coincidence, according to fact-checkers.

Whether vaccinated or not, a patient with COVID needs treatment. Pfizer’s Paxlovid™ is the officially recommended treatment, but note the “black box” warning. The AIDS-drug component, ritonavir, can cause serious adverse effects, including death, because of interactions with many commonly used drugs.

Lawsuit to Stop Retaliation by Medical Specialty Boards Filed by AAPS Educational Foundation

The Association of American Physicians and Surgeons Educational Foundation (AAPS) filed a lawsuit today in the federal Southern District of Texas, against three medical special boards for their threatened retaliation against physicians who speak out on matters of public concern. AAPS stands up for First Amendment rights of physicians who, like all American citizens, should be able to speak publicly without risk of retaliation.

“Our freedoms depend on the ability of physicians and all Americans to speak out on important issues of our day,” said Andrew Schlafly, who filed this lawsuit. “Entities holding monopolies over board certification should not be retaliating against good physicians.”

This new lawsuit asserts that “Defendants wrongly misuse their authority in a politically partisan manner to chill speech critical of positions taken by Dr. Anthony Fauci, lockdowns, mask mandates, Covid vaccines and even abortion.” This Complaint seeks injunctive and declaratory relief against several specialty Board Defendants that hold monopolies over board certification, and against the federal government for its newly created Disinformation Governance Board.

“Although only official state medical boards have the proper authority to regulate the practice of medicine, certifications by the Board Defendants constitute a de facto essential credential for practicing in most hospitals or participating in most networks,” this lawsuit asserts. “By threatening to revoke board certification of physicians, the Board Defendants improperly chill speech by physicians without the political accountability of official state medical boards,” this Complaint adds.

The Board Defendants are the American Board of Internal Medicine, the American Board of Obstetrics & Gynecology, and the American Board of Family Medicine. Each of these entities, which hold monopolies over board certification in their specialties, have declared their plans to discipline physicians who speak out.

“Criticizing Dr. Anthony Fauci should not be a basis for retaliating against a physician for speaking his mind,” Andrew Schlafly states. The lawsuit points out that many Republican senators properly rebuked Dr. Fauci for his statements that “I represent science” and that those who criticize him “are really criticizing science.” The Association of American Physicians and Surgeons Educational Foundation is a national organization that co-sponsors conferences and funds scholarships for attendance by medical students and residents.

U.S. Supreme Court Holds for Allowing Good-Faith Defense in Prosecutions for Pain Management, as Urged by AAPS

In a stunning reversal of two Courts of Appeals, the U.S. Supreme Court unanimously overturned their decisions in prosecutions of physicians who were denied a full good-faith defense in connection with their prescription of pain medications. One of the physicians had been sentenced to 21 years in prison, while the other physician received a 25-year sentence.

The Supreme Court agreed with the position taken in the amicus brief filed by the Association of American Physicians and Surgeons (AAPS), which urged allowance of a good-faith defense. “Physicians should not be placed in a Catch-22 of denying patients pain relief or facing decades in prison if prosecuted for it,” stated AAPS General Counsel Andrew Schlafly.

“Lengthy incarceration without proving criminal intent is tyrannical,” states the AAPS amicus brief in Ruan v. United States, No. 20-1410. “A 21-year imprisonment for medicating pain deters all physicians against fully treating patients who suffer.”

On Monday the Supreme Court held that “the Court of Appeals in both cases evaluated the jury instructions under an incorrect understanding of” the requirement of proof of criminal intent by the physicians. The Supreme Court concluded that “the Government must prove beyond a reasonable doubt that the defendant knowingly or intentionally acted in an unauthorized manner.”

This ruling reversed the decision of the 11th Circuit in the Ruan case and the 10th Circuit in Kahn v. United States, No. 21–5261.

“It is rare for the Supreme Court to simultaneously reverse the decisions of two Courts of Appeals,” Mr. Schlafly observes. “Perhaps the shocking sentences without proof by the government of criminal intent by the defendants compelled the Supreme Court to take its extraordinary action,” he added. “The Justices unanimously agreed that this process for punishing physicians went too far and needed to be reined in.”

Next the Courts of Appeals receive these cases back on remand in an opportunity for them to correct their errors.

Supreme Court Makes Right Decision on Dobbs, Says AAPS

The issue in Dobbs v. Jackson Women’s Health Organization, which overturned Roe v. Wade, is whether the Supreme Court of the United States has the authority to repeal medical-practice-related laws of 50 States, says the Association of American Physicians and Surgeons (AAPS).

“The federal government has no constitutional authority to regulate the practice of medicine,” states AAPS executive director Jane Orient, M.D. “The Constitution has no explicit provision establishing a right to abortion. This supposed right was not ‘found’ until 1973, when Justice Blackmun perceived it to be hidden in emanations and penumbras.”

In its amicus brief, AAPS noted that in Roe the Court relied on scientific presumptions shown to be wrong in the past 50 years of research.

“Starting with Roe, this Court’s abortion jurisprudence has repeatedly pledged allegiance to scientific fact,” AAPS writes. “The Court has a ‘constitutional duty’ to reexamine its jurisprudence given the now-repudiated ‘factual’ underpinnings of Roe’s central holding.”

The brief outlines the now-known facts of fetal development, illustrated with ultrasound images. From the instant of fertilization, development proceeds at a much more rapid pace than previously believed, AAPS notes.

The AAPS brief concludes: “States have a vital interest in protecting the ‘life of the unborn…. This Court should therefore return to the States ‘the right to readjust [their] views and emphases in the light of the advanced knowledge’ available today.”

Following the 1973 Roe v. Wade decision, organizations including the AMA weakened their ethical positions on the sanctity of life. AAPS, in contrast, remains a strong supporter for life. The Principles of Medical Ethics of AAPS state, “The physician should not condone the taking of human life in the practice of his profession, but at all times respect the sanctity of human life and seek to preserve or improve the quality of life.” In addition, AAPS resolution 2003-2 affirms, “that the Association of American Physicians and Surgeons supports the right to life of human beings from the moment of conception to natural death.”

AAPS Announces Support for Physician Who is to Be Imprisoned for Making a Speech in the Capitol

Association of American Physicians and Surgeons (AAPS) announces its support for emergency physician and founder of America’s Frontline Doctors (AFLDS) Simone Gold, M.D., J.D.,who  has been sentenced by Judge Christopher (“Casey”) Cooper to 60 days in federal prison, a year’s supervised release, and a fine of $9,500, the largest fine ever imposed on Capitol demonstrators, for the misdemeanor charge of entering a restricted building on Jan 6.

Dr. Gold was in Washington, D.C., by invitation to speak about COVID-19 at a Rally for Health Freedom on the East side of the Capitol. After all the speeches were canceled without explanation, she entered the Capitol building along with a crowd, and attempted to deliver her message there while a police officer stood by without objecting.

AFLDS explained the events of Jan 6 and the subsequent armed invasion to arrest Dr. Gold at her California home in a press statement. The Judge disagreed with Dr. Gold’s portrayal of her conduct as peaceful, in lengthy harsh comments during the sentencing. The facts of the situation were not adjudicated at a trial because Dr. Gold had agreed to a plea bargain.

Dr. Gold’s license to practice medicine is threatened because of alleged “misinformation” about COVID-19 early treatment and vaccination. The president of the Medical Board of California, attorney Kristina D. Lawson, wrote a letter to Judge Cooper prior to sentencing, alluding to a popular AFLDS video: “Doc Tracy, Physician Investigator: ‘Lawson’s Hunt.’”

“Dr. Gold put her professional life on the line in her efforts to provide extensive, life-saving information about early out-patient treatment of COVID-19 and adverse effects of mRNA vaccines,” stated AAPS executive director Jane Orient, M.D. “She made reasonable assumptions that are apparently no longer correct about freedom of speech and assembly, and equal application of the law.”

“This should concern every American,” Dr. Orient said. “Also, those who are defining ‘misinformation’ about COVID need to answer: ‘How many of the million Americans who reportedly died from COVID had received inexpensive early treatment, and how many were denied access to such treatment?’”
